1. Police

1. Police

It is your choice whether or not to involve law enforcement. No one else has that right. The hospital may NOT call the police or provide the police any identifying information without your consent.

You CAN report the incident to police by calling 911, going to a local NYPD precinct, or you can request that your Advocate and Emergency Room Social Worker call the police to have an officer meet you while still in the hospital.

You have a right to have your Advocate present during your interview with NYPD officers in the Emergency Room.

You CAN also report the incident to your college (See Reporting Options in Reach Out for an explanation).

At your request, the Victim Intervention Program can contact the police and/or the college to report the incident and advocate on your behalf.

IT IS UP TO YOU whether or not you want to involve the police.

2. Interim Measures

2. Interim Measures

The Supreme Court has confirmed that schools have an obligation under Title IX to prevent sexual assault from interfering with a student’s access to educational opportunities. Every school has a Title IX coordinator to facilitate this responsibility.

Your college should therefore provide reasonable and appropriate interim measures designed to: 1) preserve your educational experience; 2) ensure the safety of all parties involved and the college community as a whole; 3) maintain the integrity of the investigative and/or resolution process and 4) deter retaliation.

Such measures may include, but are not limited to, “no contact” orders, changes in housing assignment, and/or changes to academic schedules.

At your request, the Victim Intervention Program can help arrange for appropriate interim measures to be taken, on your behalf.

IT IS UP TO YOU whether or not you want to involve your school.

3. Victim Compensation/
Protective Orders

Victim Compensation

The New York State Office of Victim Services (OVS) may be able to help with any costs related to the crime that occurred. Such costs may include medical bills, counseling expenses, lost wages, lost/damaged property, and other types of assistance. OVS is a payer of last resort.

The Victim Intervention Program can help you file a compensation claim.

Protective Orders

An Order of Protection is a legal order issued by a state court that requires one person to stop harming another person. It is also sometimes called a restraining order, an injunction, or protective order. In New York State, you can seek a protective order from either Family Court or Criminal Court, depending on the circumstance.

The Victim Intervention Program can connect you with the legal aid you need to get an Order of Protection.
