2. Get an Advocate

Survivors are entitled to the help of an advocate. WestCOP VAS can provide accompaniment to the emergency room.

Shortly after being called, an advocate will meet and remain with the survivor throughout the hospital stay including (if desired) during the medical exam. The advocate will explain to the survivor options for receiving medical care and make sure the survivor’s voice is heard throughout the process.

If the assault occurred within 96 hours, a New York State Sexual Assault Evidence Collection Kit (also known as a rape kit) is used. If the assault took place more than 96 hours prior to the examination, the use of an evidence collection kit is generally not necessary.

The advocate will stay with the survivor during the exam, provide support, answer questions, and ensure that the survivor’s wishes are honored.

You will be offered preventative treatment for STDs and possible HIV exposure, emergency contraception, and a full medical exam. Forensic evidence can also be preserved in case you decide to report to the police at any time in the next 30 days. Everything that happens in the Emergency Department is your choice.
